Elements of private law and agricultural law

Learning outcomes

To provide fundamental legal knowledge relating to Italian private law, agricultural property, and agricultural contracts.

Course contents

Contents of the private law section: sources of law; legal activity; subjective legal situations and legal relationships; the protection of rights; legal subjects; personal rights; private autonomy and the legal system; the structure and effectiveness of contracts; structural and functional pathologies of contracts; some typical contracts: sale, exchange, and enjoyment contracts; ownership and other real rights; joint ownership; succession: an overview.
Contents of the part of agricultural law: the farm and the contracts connected to it; agricultural property; agricultural contracts.

For the private law part:

• L. Nivarra, V. Ricciuto, C. Scognamiglio, Institutions of private law, Giappichelli Editore, Turin, last ed. (limited to chapters: 1-7 inclusive; 8, paragraphs 1 and 2; 12; 14).

For the agricultural law section: students will be provided with a specific handout.

As an alternative to the texts indicated, it is possible to choose other texts, agreed from time to time with the teacher.

Teaching methods

The lessons, although predominantly theoretical, include analysis of concrete examples, allowing students to delve deeper into the practical aspects of the issues covered. The course is taught in Italian.

Assessment methods

The oral exam—which will be held after the end of the course—will consist of a discussion on three different topics from those covered in the course and will last approximately 15 minutes. The candidate must demonstrate mastery of the required legal principles, demonstrating the ability to place them within the general context of reference.
Oral exams take place during the academic calendar of the course offering, and for each exam session, students wishing to take them must register using the EsseTre platform.

The test evaluation indicators are:

• Ability to present knowledge (20%)
• Ability to connect knowledge (20%)
• Mastery of legal language (20%)
• Ability to discuss topics (20%)
• Ability to delve deeper into topics (20%)

The grade is expressed in thirtieths and to pass the exam a score of 18/30 is required (i.e. reasonably sufficient preparation both in terms of content and in terms of the expository language used).
